I purchased a commercial building in the state of Wisconsin a couple years ago. I have a tenant who has given me 30 days notice stating that their lease is not valid since I did not transfer lease to me and have lease redrafted/signed, etc. Before I go and waste money on attorney, I figured I would check here for responses. My mom bought a commercial property a few years ago, which is occupied by two business. Currently her nail saloon is one of the business and she has been leasing to a hair stylist with her own hair salon business. Well the hair stylist rents out 3 booths at her business. Well a few days ago there was a problem with the electric in the building. The tenant that owns the hair salon is pulling way to much power on her side of the building because of the 3 booth rentals using power and this is making electrical problems for the building. Well the business owner of the hair saloon hired an electrician to fix the problem and a verbal agreement was made to split the cost between my mom and her. But now all of the sudden the tenant is refusing to pay and wants my mother to pay the electrician. Should she have too? My year long lease ended and my landlord sent me a renewal. I wasn't sure if I was staying or not so I didn't notify him of acceptance or rejection. I noticed that I automatically accepted the new lease by not notifying him. I then decided to move out and moved just right next door to a new landlord's property. I notified my landlord by phone (left a voicemail) a week prior that I would be moving out. That was the last I've even spoken to him. I have left him a voice mail also that I wanted my sec deposit back. He never called me back or gave it to me. I contacted my lawyer who said he will write hima letter of Section B (below) because he never sent me a list of damages or reasons for withholding the deposit. (oh yea, i sent him a written letter of my vacating and my new addreess) it has been 30 days. Do you think I will get my deposit back? according to below, i should get DOUBLE? what do you all think?? Section 250.512. Recovery of improperly held escrow funds (a) Every landlord shall within thirty days of termination of a lease or upon surrender and acceptance of the leasehold premises, whichever first occurs, provide a tenant with a written list of any damages to the leasehold premises for which the landlord claims the tenant is liable. Delivery of the list shall be accompanied by payment of the difference between any sum deposited in escrow, including any unpaid interest thereon, for the payment of damages to the leasehold premises and the actual amount of damages to the leasehold premises caused by the tenant. Nothing in this section shall preclude the landlord from refusing to return the escrow fund, including any unpaid interest thereon, for nonpayment of rent or for the breach of any other condition in the lease by the tenant. (b) Any landlord who fails to provide a written list within thirty days as required in subsection (a), above, shall forfeit all rights to withhold any portion of sums held in escrow, including any unpaid interest thereon, or to bring suit against the tenant for damages to the leasehold premises. If the landlord fails to pay the tenant the difference between the sum deposited, including any unpaid interest thereon, and the actual damages to the leasehold premises caused by the tenant within thirty days after termination of the lease or surrender and acceptance of the leasehold premises, the landlord shall be liable in assumpsit to double the amount by which the sum deposited in escrow, including any unpaid interest thereon, exceeds the actual damages to the leasehold premises caused by the tenant as determined by any court of record or court not of record having jurisdiction in civil actions at law. (c) The burden of proof of actual damages caused by the tenant to the leasehold premises shall be on the landlord. (d) Any attempted waiver of this section by a tenant by contract or otherwise shall be void and unenforceable. (e) Failure of the tenant to provide the landlord with his new address in writing upon termination of the lease or upon surrender and acceptance of the leasehold premises shall relieve the landlord from any liability under this section. My husband and I are having a discussion about our shop lease space, and the current economic climate. I feel that for the best security of our business, we should own the building but, at present, the owners are not interested in selling. This brought up a question that neither of us had considered before. Hi I recently bought a commercial garage, which my intial plans where to run a tyre business out of. When i was buying the garage from the previous owner he insisted that i could not carry out any mechanic work or MOT's for a year, apart from the fitting of tyres and alloy wheels. The lease provides for annual cost of living adjustment (COLA) increases; however, the landlord never requested that I pay a COLA increase. It just seems wrong to force out a meaningful local member of the community and replace with yet another piece of big business blight! I've witnessed the rent-induced demise of too many great local businesses: such as my local guitar and music store, my vacuum repair shop, my jewelery repair, and one of my favorite little independent grocery stores. All of these proprietors were forced out by greedy and unscrupulous landlords who imposed impossible increases in rental rates. (some increases were 25-45%). I have had an issue with a rental agency. I didn't know my old lease prevented me from putting personal property in an (enormous) multi-car garage that I had rented for 3-4 years. The lease, it turns out, lets them haul away any personal belongings left there. The REAL question I have is since this is NOT a residence for me, does it qualify as a commercial lease? Unfortunately I got caught in the burst of the bubble in real estate and have not been able to pay my debts. How can I protect my agents commissions from garnishment that is as a result of a personal guaranteed on a commercial lease? We have only sold three (3) properties this year, and less than five (5) last year. We are trying to hold on until the market turns. In the meantime, an order of garnish has been set against my personal bank account because that was the only one they could find at that bank. Hi there.... Need some assistance PLEASE re Body Corp fees. I lease a commercial property and pay the Body Corp fees. I have received my first invoice and paid a quarter of the Body Corp fee and advised the Agent I would be paying quarterly (which I believed I was allowed to do). Here's the situation: I had a commercial tenant leave recently, When they left, they left some damage on the property. They also left things that I have to deal with - some fixtures that will be a bit costly to remove. Prior to them leaving, I told them that they could take with them another piece of equipment that was there before. But now, as they have just left, I have these expenses which are also violations of our lease. And now he still wants that piece of equipment that I said I would give him. My inclination is to simply say "you can only have that piece of equipment when you make right these damages and fulfill your obligations in the lease". Can I do that? Or should I give them the equipment and then look to take action against them? I kind of don't want to do this second option because I will find myself out of pocket and in a protracted legal conflict with them if I do. Any suggestions?Tom P - That's right. I have no written agreement with this person saying that they can take the equipment. I simply told them that I would "let" them take it when they left. I just leased a commercial property. There is what appears to be a working water fountain. When I plug it in, I hear the compressor (or whatever it is that makes water cold) kick on. However, when I push the button for water nothing happens. Is there any way to find out if the fountain works? Is there a valve that may be turned off to the fountain somewhere? I have limited access to the back of the fountain but no access to the front. The rest of the water in my space is on, and there is only one master on/off valve to the water for the space, and it's on.THANK YOU! Here's the situation: My commercial tenant is leaving his rental space. We agreed to end the lease on certain conditions. I had no real problem with how it all played out, except for when I discovered a large piece of equipment that he told me he wouldn't be taking with him. At first I was kind of mad and I demanded that it be taken away. He said it would be a major hassle to do this. However, our agreement says he must do it. For a while I wasn't sure what to do. Then, all of a sudden, someone said they'd pay me decent money for the piece of equipment. And they said they would handle the dismantling and removal of this heavy item as well. While I am weighing this offer, I am wondering: Could my tenant come back and demand the equipment, despite having verbally telling me he would be leaving it and I would just have to "deal with it"? Could the tenant demand a share of the sale? I have 2 5 ton A/C units on loan from my brother-in-law (A/C guy) that are NOT my property. He's going to resell them for at least $1000 each. They are freestanding, sitting on cinder blocks. They are the ductless type of units. They are NOT permanently mounted in any way to the building I am leasing. There is simply a hole cut in the wall for the wiring to go through to the outside part that is also sitting on cinder blocks. My landlord knew up front that these were leased, they are NOT my property, and would be removed at the end of the lease. Now that he's showing the property, he's made a point to tell me they are staying. Can he do this, knowing they are not my property to leave here and that they were deliberately not permanently mounted?
